Sometimes, a dispute regarding land has to do with the way one person’s land is affecting the other's. Water, as we all know, flows downhill and can inadvertently cause damage to another person's property, such as basements, walls, and gardens. Generally speaking, property owners are not responsible for damage that result from the natural condition of their property. However, in cases where changes to the land result in drainage issues that disturb another property, it is possible that they could be held liable under certain circumstances.

An easement is a non-possessory interest in land that gives a person a right to use the land of another. To put more simply, it allows a person who does not own land to use it in a certain way. Imagine, for example, two houses that share a driveway that opens to a garage behind each house, but the driveway itself is owned solely by one of the homeowners. The other property would likely have an easement appurtenant (one that transfers with the land) that allowed its owner to use the driveway to access the garage. Disputes regarding easements often arise when one party changes the way in which he or she is using the easement or attempts to use the property in a way that is outside the scope of the easement.

Many land use disputes arise in situations where one party is using his or her land in a way that is affecting another party’s ability to enjoy or use his or her land. In such cases, the use of the land may constitute a nuisance, and the affected party may be able to seek relief by filing a lawsuit seeking injunctive relief and damages.
